One of the first questions we are always asked about a divorce is “How long will my divorce take?” Unfortunately the answer is not that simple.
The time taken would depend on a number of factors, but below are few important ones to be considered:
- whether your divorce will be contested or uncontested;
- whether the divorce parties are in agreement or not before the commencement of the divorce proceedings;
- which jurisdiction either of the parties reside in;
- and which court (i.e. High Court or Regional Court) the parties will be divorced in.
A contested divorce simply means that the parties are not in agreement from the onset of the divorce. Contested divorces become quite complex and legal assistance will be required.
An uncontested divorce is where the parties are in agreement when the divorce proceedings commence or the other party will not be defending the divorce.
